The payslip is the point where three sets of rules meet: the applicable collective agreement, the contribution to Social Security and the IRPF withholding, which in the Basque Country and in Navarra is foral. A mistake in any of the three is not noticed in the month it is made, but when the regularisation arrives.

The withholding is calculated with the foral table

The personal income tax (IRPF) withheld from the payslip is governed by the rules of Bizkaia, Gipuzkoa, Araba or Navarra according to the company’s registered tax address, not by the state rules. We apply the table that corresponds, we file the withholding return with the competent Foral Tax Authority and we regularise during the year when the employee’s circumstances change.

State, regional and provincial collective agreements

In the Basque Country agreements from all three levels coexist, and choosing the wrong agreement or contribution group translates into contribution differences with a surcharge. Before the first payslip we establish the applicable agreement, the professional classification and the company’s working calendar.

The full hiring cycle

Registrations and deregistrations, choice of contract type, extensions, temporary incapacity, leave, career breaks and final settlements. We review the rebates the company is entitled to — leaving them unclaimed is an avoidable extra cost — and we keep the diary of expiry dates so that no extension misses its date.

Labour Inspectorate and disputes

We take on the company’s representation before the Labour Inspectorate and in employment disputes, from the reply to the inspection report through to court proceedings where necessary. When a matter calls for litigation, the group’s Legal division steps in.

Coordinated with tax and accounting

Staff costs are the heaviest item for most SMEs. Because the employment, tax and accounting work is done within the same group, the payslip, the accounting entry and the year-end close agree with one another. We also deliver the salary and social cost reports used to budget a hire before making it.

Frequently asked questions

Is the IRPF withholding on the payslip the same as in the rest of Spain?
No. In the Basque Country the foral table of Bizkaia, Gipuzkoa or Araba applies according to the company's registered tax address, and Navarra has its own. A payslip calculated with the state table comes out wrong and has to be regularised afterwards.
What is the difference between a gestoría and an employment advisory firm?
A gestoría processes paperwork. An employment advisory firm also analyses the applicable collective agreement, the rebates the company is entitled to and the risks of each decision, and it represents the company before the Labour Inspectorate.
From how many employees is it worth outsourcing employment administration?
From the first hire. The cost of a Social Security regularisation or of a penalty from the Labour Inspectorate comfortably exceeds that of employment administration done properly.
