If you are faced with an unpaid invoice, claim for the loss you have suffered. If a customer fails to meet a payment on its due date, remember that you can claim both the costs incurred and late payment interest.

Costs you can claim

Every cost you have incurred as a result of the non-payment. For example:

  • The cost of sending a burofax demanding payment of the debt.
  • The charges passed on by the bank as a result of the non-payment.
  • Third-party fees for carrying out debt recovery work.

If you have not incurred any cost, you can still claim a fixed sum of 40 euros, which is added to the outstanding principal.

Late payment interest

In commercial relations between businesses, it is enough for the debtor to miss the agreed payment deadline for that late payment interest to be claimed.

The interest you can claim is whatever the parties agreed. And if nothing was agreed, you can demand the late payment interest rate that the Ministry of Economy sets every six months, which for the second half of 2021 was set at 8%.
